LEGAL REGULATION OF UKRAINE'S PUBLIC POLICY IN THE EDUCATIONAL SPHERE UNDER THE CONDITIONS OF DIGITAL TRANSFORMATION OF SOCIETY

Abstract

чThe article explores the peculiarities of the legal regulation of Ukraine's public policy in the educational sphere under the conditions of the digital transformation of society. The focus is placed on the global processes of digitalization, informatization, and cognitivization as key factors in forming a holistic and coherent state policy in education. It is determined that priority areas in this context include the development of digital competencies, modernization of educational infrastructure, and ensuring the continuity of the educational process. The evolution of the legal framework defining the vectors of digital development in education is analyzed: from the formation of the foundations of the information society to contemporary strategies, concepts, and programs for the digital economy, e-governance, and integrated information systems in education. It is established that legislative and regulatory acts create the institutional conditions for the implementation of electronic educational resources, digital platforms, automation of management processes, and the development of distance and blended learning formats. Particular attention is paid to the role of state strategies and concepts in forming unified approaches to the development of digital skills and competencies, which is a necessary prerequisite for the effective implementation of public policy in education. The specifics of the digital transformation of the educational process under martial law are revealed, specifically the dominance of distance and hybrid learning forms. Key challenges in the educational sphere are identified, related to infrastructure destruction, limited access to technical resources, instability of power supply and Internet connectivity, as well as the psychological burden on participants in the educational process. The expediency of using the bichronous learning format as a tool for increasing the flexibility and continuity of education is substantiated. The study proves that effective legal regulation of the digital transformation of education is a crucial instrument for ensuring the quality of educational services, adapting the educational system to crisis challenges, increasing its resilience in military and post-war contexts, and integrating Ukraine into the European educational and digital space.
